DEALING WITH REGULATORS

Dealing with the regulator

Businesses can often find themselves having to deal with the health and safety regulator – either the Health and Safety Executive or Local Authority Inspectors. They can serve enforcement notices that can be very disruptive to your business. We can help you identify and implement the necessary measures to comply with an enforcement notice.

If you feel a notice has been incorrectly served we can help support you or your legal representatives through the appeal process.

Criminal and civil proceeding

We can work with you and your legal representatives to prepare a defence and mitigation for criminal prosecutions by the regulator and civil proceedings. Our extensive investigation experience, including serious and fatal accidents, enables us to conduct robust independent investigations, under legal privilege if required.

Fee for intervention

If a Health and Safety Executive Inspector visits your workplace and finds that you are in material breach of health and safety law, you will have to pay for the time it takes the Inspector to identify what is wrong and to help you put things right. This is called a fee for intervention (FFI).

These fees can be very high. We can support you if you decide to query or dispute your FFI invoice.

Specialist support for insurance companies and solicitors.

Our extensive regulatory and private sector experience in Scotland and England means we are ideally placed to support solicitors and insurance companies working for clients facing regulatory enforcement action.
